Ripple vs. SEC: The arrival of Judge Netburn marks a crucial turning point

Judge Analisa Torres recently handed down her verdict in the XRP case between Ripple and the SEC. The decision, favorable to the crypto firm, is however only partially settled.

Towards new developments in Ripple’s case against the SEC?

The SEC has left it unclear whether it will appeal Judge Analisa Torres’ decision. In the meantime, Torres has transferred the case between the regulator and Ripple to another magistrate.

The latest news is that Judge Sarah Netburn will have the heavy responsibility of deciding the case, potentially definitively this time. This development is therefore an important step towards resolving the case in accordance with American legal procedures.

Indeed, after the verdict has been rendered, these procedures provide for a general pre-trial phase. This is a procedure which often involves the gathering of evidence and the formulation of objections.

As a general rule, when a legal battle reaches this stage, the protagonists are more inclined to negotiate a settlement. It’s an option that the SEC may well prefer, given that its back is already against the wall in the current circumstances.

In any case, experts believe it unlikely that the regulator will appeal Ripple’s decision. This would explain why, despite its zeal to attack the crypto industry, the SEC is still silent on its strategy.

For the time being, these same specialists believe that Ripple could once again get off lightly. Judge Sarah Netburn was the one who ordered the disclosure of Hinman’s documents.

In the end, they had no real impact on the case. It’s not out of the question that the magistrate might be sympathetic to Ripple. This, given Judge Netburn’s track record in challenging SEC assertions.
