The judicial dates that redefine the Ripple case

December 23, 2024, marks an important milestone in the case opposing Ripple and its plaintiff, Bradley Sostack. The latter will have to submit a mediation questionnaire, which will thus mark the beginning of a series of procedures strictly governed by the judicial calendar. The order for the appeal transcripts is scheduled for December 31, and they must be fully delivered by January 30, 2025. These deadlines, set with precision, highlight the importance of a rigorous process, as any failure could lead to the abandonment of the appeal.

In this context, March 2025 will be decisive. The plaintiff will present detailed arguments against Ripple and its CEO, Brad Garlinghouse, a major figure in the crypto world. Thus, for their part, Ripple Labs and Garlinghouse will have to respond by April 7. This legal face-off, which comes after several favorable preliminary decisions for Ripple, illustrates the growing tensions surrounding cryptos and their regulatory implications. The status of XRP, and beyond that of many cryptos, could be durably affected.

At the same time, budgetary tensions in the United States loom with the threat of a government shutdown, a situation that puts the Securities and Exchange Commission (SEC) in a particularly vulnerable position. If the agency’s activities were to be suspended, it could be forced to delay its response in this strategic case. Such a delay would provide Ripple with a welcome pause in its legal efforts but would not fail to prolong the uncertainty surrounding the regulatory status of XRP. This uncertainty represents a major source of concern for investors, already burned by the legal instability surrounding cryptos.

However, this context raises questions about the effectiveness of American regulators, frequently criticized for their inability to establish clear and coherent frameworks for the crypto industry. As the market evolves rapidly, this sluggishness fuels a legal gray area that stifles innovation and exacerbates the distrust among industry players. Consequently, observers are questioning how the authorities might succeed in balancing support for innovation and the protection of investors.
